The Trump Gold Card initiative allows for obtaining permanent residency in exchange for making a financial contribution of seven figures. For the majority of people, getting an EB1A green card will always be faster and cheaper on a better legal basis. Originally, the Gold Card initiative was an idea for February 2025 to end the EB-5 investor visa program through introduction of an additional fee of $5 million per individual. How the Gold Card Actually Works

  2. Pay a nonrefundable government processing fee.
  3. If vetting clears, file Form I-140G requesting EB-1A or EB-2 NIW classification, supported by the same evidence any EB1A or NIW petition would require.
  4. Once USCIS confirms the petition is ready, wire the required gift.
  5. Proceed to consular interview or adjustment of status, the same steps as any other employment-based green card case.

There is no job-creation requirement, and the money is structured as a one-way gift rather than an at-risk investment, meaning it isn’t returned if the petition is later denied.

EB1A vs Gold Card: Which Is Actually Faster?

This is the question that most of the self-petitioners are interested in knowing, and the truth is, there isn’t any way by which it is achieved. USCIS provides a process of premium processing where they complete the processing within 15 business days for standalone EB1A visa petitions and 45 days for the NIW petitions. However, the Gold Card does not reduce either of these time periods, rather adds a time-consuming pre-screening process before the normal adjudication process.

The more important aspect about the Gold Card is that it comes from the exact pool of EB-1 and EB-2 green card numbers as the traditional petitioners, and hence there is no separate allocation. Each of the approved Gold Cards reduces the availability of one number in the category. This means that the applicants from the backlogged countries such as India and China do not get any relief in terms of wait period even after paying. EB1A Requirements and Eligibility

No change was made to the EB1A criteria due to the Gold Card, which needs to be emphasized: the executive order can’t make amendments to the Immigration and Nationality Act. A single, major internationally recognized award, a Nobel Prize is the standard regulatory example, can satisfy the standard on its own as a “one-time achievement.” For most applicants, meeting three or more of the above criteria with well-documented evidence remains the actual path to approval, gift or no gift.

EB1A Processing Time vs Gold Card Timeline

The time for EB1A approval with premium processing is 15 business days after which there will be either a decision or request for additional evidence from USCIS. Otherwise, without premium processing, standard processing will take several months, depending on the workload at the respective service center. Gold Card is not going to accelerate the process, according to DHS, which has admitted in court papers that applications with Gold Cards are not guaranteed to be processed faster than other applications.

For both pathways, the major factor affecting the timeline is the same, and it relates to visa number availability through the Visa Bulletin. Unless one’s preference category and chargeable country have a current visa number, one cannot do anything, even if one pays for premium processing.

Litigation Risk: The Legal Challenge Facing the Gold Card

The Gold Card being based on an executive order and not an act of Congress makes it subject to legal uncertainty. A group of academic associations and immigrant professional organizations sued the federal government in U.S. District Court of District of Columbia in February 2026, claiming that only Congress can establish a visa category or define evidentiary basis for it and that the way the payment is funneled into EB-1A/EB-2 NIW is beyond Congress’ authority. A major labor union then joined the case.

At the time of this writing, there have been no rulings on the merits and there has been no injunction against the program. The motion to dismiss by the government was based on standing, not on the legality of the program itself. Further briefing is scheduled in 2026. Since there is significant non-refundable expense involved, in the range of millions, and since the legal underpinning of the program is the executive order which may be changed or even rescinded by the next administration, the applicants are taking some degree of risk that does not apply to regular EB1A green card petition.

In addition, the uptake of the program has been way below the government’s initial expectations of 80,000 approvals and over $100 billion in revenue. There are only hundreds of people who had started applying for the program several months after its launch based on documents filed in public courts.

Which Green Card Is Best for AI Professionals and Founders?

For AI researchers, engineers, and startup founders, the calculus is usually straightforward. Members of that cohort almost invariably have all the basic ingredients of a green card for an extraordinary ability: published work, patents, well-above-market compensation levels, speaking engagements, media mentions, or technical leadership roles within a prestigious firm. Turning such a track record into a convincing EB1A or EB-2 NIW application is much less expensive than paying even the minimum amount of money needed to start down the path toward qualifying for the Gold Card and comes with no risk of giving away seven-figure sums with little hope of seeing anything in return.
